In a recent landmark decision dated 19 March 2025 (ATF 4A_239/2024), the Swiss Supreme Court reiterated the mandatory nature of the rule requiring landlords to formally notify tenants of the rent-setting notice when concluding a new lease agreement.

In the same decision, the Swiss Supreme Court also highlighted the severe consequences that may result from a breach of this rule, namely: the invalidity of the rent stipulated in the lease, the determination of a new rent, and the reimbursement to the tenant of any rent overpaid.
