Patrick Blaser comments in Le Journal de l’Immobilier on the decision of October 10, 2023, rendered by the Swiss Supreme Court (ATF 4A_143/2023) regarding illegal subrentals.

 

This decision confirms that a landlord can validly terminate a lease with a tenant prematurely when it is revealed that the tenant intends to sublet the residence permanently, meaning without the intention of reoccupying it in the near future.
