They also examine the practical complexities of its introduction and how it would interplay with the recent creation of the complex chambers in the Tribunal of First Instance. A key distinction is that a Commercial Court is a single instance cantonal jurisdiction, composed of professional and lay judges with business expertise, which foreign parties could designate as the competent forum for the resolution of their commercial disputes in English.
