Josef Alkatout, Head of Family Law at Borel & Barbey, is the guest writer of La Tribune de Genève in which he looks over the recent Geneva Law on Mediation (LMéd-Ge).
In a nutshell:
– Civil judges are supposed to encourage the parties to try mediation whenever suitable.
– It is, however, not certain that mediation is the appropriate solution in case of highly contentious litigation.
– A better means against the courts’ significant workload would be an increase of the judicial sector’s funds.
